Welcome to BetterThumbnail! These terms govern your use of our AI thumbnail and title generation service. By using BetterThumbnail, you agree to these terms. Please read them carefully.

1Acceptance of Terms

By accessing or using BetterThumbnail, you agree to be bound by these Terms of Service and our Privacy Policy. If you don't agree, please don't use our service.

You must be at least 13 years old (or 16 in some jurisdictions) to use BetterThumbnail. If you're under 18, you need parental consent.

2Proper Use of the Service

BetterThumbnail is designed to help creators make amazing thumbnails. Please use it responsibly.

✓ You can:

  • Generate thumbnails and titles for your content
  • Use generated content commercially (you own it!)
  • Share and publish your creations anywhere
  • Use the service for client work

✗ You cannot:

  • Generate illegal, harmful, or deceptive content
  • Create content that violates others' rights
  • Attempt to reverse-engineer or hack the service
  • Use automated scripts or bots to abuse the service
  • Resell or redistribute our AI models or technology
  • Generate content depicting minors inappropriately

3Account Responsibilities

  • You're responsible for keeping your login credentials secure
  • You're responsible for all activity under your account
  • One account per person—no sharing accounts
  • Notify us immediately if you suspect unauthorized access
  • Keep your account information accurate and up-to-date

4Payments & Subscriptions

💳 Billing

  • Payments are processed securely via Stripe
  • Subscriptions renew automatically unless cancelled
  • Prices are in USD unless otherwise stated
  • Applicable taxes may be added to your purchase

🔄 Refunds

  • Credits and one-time purchases are non-refundable once used
  • You can cancel subscriptions anytime—access continues until the billing period ends
  • Contact support for billing issues within 7 days

📊 Credits

  • Credits are used to generate thumbnails and titles
  • Unused credits may expire based on your plan terms
  • Credits cannot be transferred or exchanged for cash

5Intellectual Property

🎯 The simple version:

  • Your content is yours. You own all rights to thumbnails and titles you generate.
  • Our tech is ours. BetterThumbnail, our AI models, and platform remain our property.
  • You keep your inputs. Images and content you upload remain yours.

By uploading content, you grant us a limited license to process it for service delivery. We don't claim ownership of your uploads or outputs.

6Service Availability & Changes

  • We strive for 99.9% uptime but can't guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance when possible
  • We may modify, suspend, or discontinue features with notice
  • AI outputs may vary—we don't guarantee specific results
  • We're always improving—new features may be added or changed over time

7Limitation of Liability

BetterThumbnail is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

  • We're not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the last 12 months
  • We don't guarantee that AI-generated content will meet specific requirements or expectations

Note: Some jurisdictions don't allow limitation of liability. In such cases, our liability is limited to the fullest extent permitted by applicable law.

8Termination

You can leave anytime: Cancel your subscription and delete your account from your settings.

We may terminate accounts that:

  • Violate these terms or our policies
  • Engage in fraudulent or abusive behavior
  • Remain inactive for extended periods (we'll notify you first)

Upon termination, your right to use the service ends. You can request your data before account deletion.

9Governing Law & Disputes

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

For users in the European Economic Area, you retain all rights afforded under GDPR. For users in India, provisions of the Information Technology Act, 2000 and related rules apply as applicable.

We encourage resolving disputes through good-faith communication before pursuing formal proceedings.

10Updates to Terms

We may update these terms as our service evolves. For significant changes, we'll notify you via email or an in-app notice at least 30 days before they take effect. Continued use after changes means you accept the new terms.
